Please take a moment to read our Website Terms of Use and these additional Emerging Minds Learning Terms of Use (together, the ‘Terms’). By accessing or using the Emerging Minds Learning website, you are agreeing to the following Terms.

In these Terms, ‘Emerging Minds’, ‘we’, ‘us’ and ‘our’ refer to the Australian Infant, Child, Adolescent and Family Mental Health Association Ltd (AICAFMHA), trading as Emerging Minds.

If you do not agree with these Terms, please do not use the Emerging Minds Learning website.

Use of training materials

The information contained in the training materials, including training information, references to resources, practice examples and supporting materials, is presented for workforce education and training purposes only. The information contained in the education and training materials does not replace, supplement or abrogate professional or clinical judgement or decision-making.

Safety statement

The content of the training material includes information about children and families experiencing or exposed to health problems, adversity and trauma. You may experience a range of emotions, including sadness or discomfort, as you view and hear from some of the children and parents. These responses may relate to your own experiences, to children and families you know, or to the experiences of children and families more generally. As you work through the course, it is important to be aware of your own emotional responses. Seek help if needed.

Here are some tips for self-care:

  • We do not recommend undertaking an entire course in one sitting. Give yourself some breaks. Even if you feel that you don’t need a break, it’s a good idea to take one anyway and come back later.
  • Be aware of your emotions as you progress through a course and take action if you are starting to feel stressed or upset. Consider doing something for yourself that you enjoy.
  • Be aware of your emotions after a course is completed. Think of things you enjoy and do one of those things.
  • Spend time with friends, family or others that care about you.
  • If you find you are struggling, please talk with your supervisor, seek help or call Lifeline on 13 11 14.

We ask that you take care of yourself throughout the training program and, if you need a break, please take one. The dramatised families in these resources are fictional and the family members are portrayed by actors.

No warranties

While reasonable efforts have been made to ensure the accuracy, currency and completeness of the information contained in the training materials, no warranty is given that the information is free from error or omission. Some of the terminology used may not be familiar to you as it is commonly used within Australia. If the terminology is not familiar to you, it is important for you to immediately stop using the training materials and to seek clarification of the terms. The training materials are provided on an ‘as is’ basis and any use of the training materials is at your own risk.

To the maximum extent permitted by law,  Emerging Minds, its directors, officers, employees, consultants, agents or other representatives disclaim any and all liability for the accuracy, completeness or currency of the information contained in the training materials, their use for the purposes specified in this notice, any and all legal responsibility whether such arises in contract, tort or statute for damages or compensation arising from the use of the training materials, or for any act or omission by any users resulting from reliance on the information provided, or for any consequences arising from such act or omission.

Emerging Minds does not accept any liability for any injury, loss or damage incurred by use of or reliance on the information by any user or third party and a user by their use of the training materials agrees to indemnify Emerging Minds, its directors, officers, employees, consultants, agents or other representatives against any damages, compensation or costs including, without limitation, any direct, indirect, special, incidental or consequential damages.

In no event shall Emerging Minds or their directors, officers, employees, consultants, agents or other representatives be liable to you for any indirect, special, incidental, consequential or punitive damages (including without limitation loss of profits, loss or corruption of data, loss of goodwill, work stoppage, computer failure or malfunction or interruption of business), regardless of whether Emerging Minds or their directors, officers, employees, consultants, agents or other representatives have been advised of the possibility of such damages.

Users

All users of the Emerging Minds Learning website are responsible for their own conduct, including any data, text or information they submit or upload to the website. To the extent necessary, a user that submits any data, text or information provides Emerging Minds with a to use such data, text or information on this website. Under no circumstances is any user permitted to include on this website data, text or information which is:

  • misleading or deceptive;
  • false or inaccurate;
  • infringes any person’s copyright, trade mark or other intellectual property rights; or
  • defamatory, threatening, unlawful, obscene, intimidating or racially offensive.

Emerging Minds reserves the right to restrict or suspend a user’s access to the Emerging Minds Learning website where necessary.

You agree to use Emerging Minds Learning in a lawful, respectful and appropriate manner. You must not interfere with the functionality of the website, attempt to gain unauthorised access or use automated systems to extract or reproduce content.

Workplace Dashboard account conditions

To access features such as online courses or the Workplace Dashboard, you must create an account. You are responsible for ensuring the accuracy and completeness of the information provided.

You are responsible for maintaining the confidentiality of your credentials. You must notify Emerging Minds immediately at [email protected] if you suspect any unauthorised access. Emerging Minds will not be held liable for any loss arising from unauthorised access to your account.

If your account is linked to a workplace dashboard, you acknowledge that your progress and completion reports may be accessible to your designated organisational administrator for continuing professional development (CPD) purposes.

Users may request to have their account removed by contacting [email protected]. Once an account is removed, all information on the Website that is accessible only through an account will be removed and will no longer be accessible or recoverable.

By providing your contact details, you consent to receiving communications from us via email regarding research updates and training. You may opt out of communications at any time via the ‘unsubscribe’ link in our emails.

Complaints resolution

You agree that if you have any complaint associated with services provided by Emerging Minds that you will comply with the following complaint process:

  • You will contact Emerging Minds promptly and outline your complaint in writing providing all relevant details.
  • You will allow Emerging Minds 30 days to respond to your complaint in writing thereafter you will enter into good faith discussions with Emerging Minds to resolve the complaint.

If a satisfactory resolution to the complaint cannot be achieved you will enter into mediation with Emerging Minds prior to pursuing any legal action to the extent permitted by law.

External websites

The Emerging Minds Learning website contains links to other websites. These links are provided for information only and do not constitute endorsement or approval by Emerging Minds of linked website or any third-party products or services. You are responsible for assessing the accuracy, completeness, currency, reliability and correctness of information contained in other websites. You should also review the terms of use, copyright and disclaimer conditions of any external website you access. The views or recommendations provided in linked sites do not necessarily reflect those of Emerging Minds.

Privacy

We take your privacy seriously. Any personal information shared through Emerging Minds Learning is handled in line with our Privacy Policy.

The Emerging Minds Learning website collects and uses information about visits to and use of the site for statistical analysis of site traffic and to improve the website for users. This may include the user’s IP address, date and time of visit, pages accessed and documents downloaded, previous websites visited and type of browser used. No attempt will be made to identify an individual user’s browsing activities except where required by law or where a user has failed to comply with terms, in which case such information may be used to restrict or deny the user access to the site.

The Emerging Minds Learning website collects and retains personal information from users of the training materials. This information includes personal information collected during the registration process and information relating to completion of training, including completion certificates. Such personal information may also be used to notify you of updates and new learning materials produced by Emerging Minds, unless you opt out of receiving these communications. These details are stored in a secure server location and will not be used for any other purpose. Outside of this use, your personal information will not be disclosed to any third party without your consent except where required by law.

The Emerging Minds Learning website collects and records user responses to scenarios and learning materials for reflective and assessment purposes. This material may be used to improve and evaluate the resource. Collated, de-identified material may be used for promotion, evaluation and publication of this resource. You will not be identified or acknowledged as the author of this material except where required by law.

Security

You should note that there are inherent risks associated with the transmission of information via the internet. You should make your own assessment of the potential risks to the security of your information when deciding whether to use this site.

Emerging Minds does not represent or warrant that the Emerging Minds Learning website or any other information or material contained in, downloaded form or accessible from the website, is free from computer malware (including but not limited to viruses, worms, trojans, spyware, adware) or any other defect or error which may affect your software or systems. You should protect your software and systems by installing and implementing your own security and system checks.

Emerging Minds may withdraw or suspend the Emerging Minds Learning website, or access to it for any reason including, without limitation, where there is an interruption, fault, virus, unauthorised access or other malicious attack on Emerging Minds’s system or where maintenance or upgrading of the system is required.

General terms

Emerging Minds shall not be liable for any failure by it to perform these Terms, or for any loss or damage suffered by you in consequence thereof where such failure arises from any cause whatsoever beyond the control of Emerging Minds including (but not limited to) computer, communication or network failures, fire or other accident, strikes or other labour disputes, any computer virus introduced by a third party, or any other law, proclamation, regulation or ordinance or any government agency.

If you breach these Terms, Emerging Minds may suspend, terminate or limit your access to this website. If Emerging Minds does not act in relation to a breach by you of these Terms, this does not waive Emerging Minds’s right to act with respect to subsequent or similar breaches.

These Terms are governed by the laws of South Australia and the Commonwealth of Australia. You submit to the exclusive jurisdiction of the courts of South Australia.

Emerging Minds Learning is funded by the Australian Government to provide learning resources for the Australian workforce. The content is developed for an Australian context and may not be applicable in other jurisdictions.

These additional Terms, together with the Website Terms of Use, constitute the entire legal agreement between you and Emerging Minds in respect of Emerging Minds Learning and supersede all prior communications or representations. In the event of any conflict between the Website Terms of Use and these additional Terms, the Website Terms of Use will prevail to the extent of the inconsistency.
